Chemical products that contain highly fluorinated substances (PFAS)

Regulations amending the Swedish Chemicals Agency’s regulations (KIFS 2017:7) on chemical products and biotechnological organisms

A party who is to notify products to the Swedish Chemicals Agency’s Products Register, in addition to the information that presently shall be registered, shall also provide additional information if the product contains PFAS. Only the presence of PFAS shall be notified; individual substance names need not be specified. It is proposed that this shall apply to PFAS which have been intentionally added to the product, regardless of concentration. The relevant PFAS are defined with chemical structural formulae. Exemption from the notification obligation is proposed for companies with an annual turnover of less than SEK 5 million.

Under this draft, those product groups which are already exempt from the required registration in the Products Register will remain exempt. This is the case for waste, foodstuffs and animal feed, medicinal products, cosmetics and tattoo inks. In the original draft, which is discussed in the attached impact assessment, the presence of PFAS according to the specified definition was to be notified to the Products Register. The draft that is now attached is somewhat revised and now only covers PFAS that have been deliberately added.
