Background of the amendment

- As the Aviation Security Act introducing performance certification system of aviation security equipment was amended and proclaimed on October 24, 2017, aviation security equipment operators shall use aviation security equipment with the performance certificate issued by the Ministry of Land, Infrastructure and Transport (MOLIT).

- According to the amendment, MOLIT also plans to secure professionalism and reliability of the system by designating separate institutions for certification and for testing procedure along with constant supervision of the entitled organizations.

- In this context, MOLIT proposes to partly amend the enforcement regulation of Aviation Security Act in order to implement the performance certification system such as performance certification procedure, a performance certification test, performance verification and inspection, and criteria of commission imposition.

Major amendments

- MOLIT gives shape to an action plan of the performance certification for aviation security equipment as follows;

- Standards for performance certification: standards for functions, performance, and safety of aviation security equipment are set up and manufacturers shall have capacity to produce equipment to meet the standards

- Process for performance certification: the performance certification process including application for performance certification, performance certification and request for a performance certification test is specified

- Performance certification test: the testing institution is assigned to conduct a performance certification test to verify suitability of equipment performance for the above certification standards

- Performance verification: service life of equipment can be extended if the equipment passes performance verification

- Performance inspection: equipment with a performance certificate is regularly or irregularly inspected to check if it maintains its performance and quality at the initial certification

- Composition and operation of committees: MOLIT can organize and operate committees for certification review and designation of the testing institution. In the case of the certification review committee, the certification institution is allowed to organize and operate it

- Operation of the testing institution: details concerning the operation of the testing institution including the testing institution’s roles, criteria of designation (or cancellation of designation) and suspension of service are specified - Criteria of commission: criteria of commission to the certification and testing institution are set up
