Draft Order of the Minister for the Environment of the Republic of Lithuania amending Order No D1-901 of the Minister for the Environment of the Republic of Lithuania of 10 December 2015 approving Technical Regulation for Construction STR 1.01.04:2015 ‘Assessment, verification and declaration of the constancy of performance of construction products without harmonised technical specifications – Designation of testing laboratories and certification bodies – National technical assessments; designation and publication of technical assessment bodies’

The draft order proposes that Construction Technical Regulation STR 1.01.04:2015 be supplemented with a paragraph regulating the implementation of performance constancy assessment and verification where a construction product is not included in the List or Regulated Construction Products approved by an order of the Minister for the Environment of the Republic of Lithuania. With a view to defining more comprehensive requirements for the designation of testing laboratories and certification bodies, adjustments to paragraph 17 have been proposed.

Moreover, a new paragraph 17(1) has been drafted, which stipulates that a body which has accreditation in the field of construction products for which a European Assessment Document (or, alternatively, an ETAG) defines the requirements, and wishes to become a designated body, provided that products in this field are covered by national technical assessments, may, in lieu of documents substantiating its compliance with the requirements set out it Chapter VII of the aforementioned regulation, submit its accreditation certificate issued by the National Accreditation Bureau under the Ministry of the Economy, certifying that the body has been accredited to perform assessment and verification of the constancy of performance of such construction products in compliance with the requirements of Regulation (EU) No 305/2011, as well as a copy of the body's civil liability insurance and information concerning the objectivity of its personnel.

The draft order sets out in detail the actions of the Ministry for the Environment leading to the suspension or revocation of the designation of a designated body in the event of failure to meet the established requirements, defines requirements for the keeping of records subsequently to a designated body ceasing to perform its functions in that capacity, and establishes the duty for designated bodies to ensure compliance of their branches and subcontractors with the established requirements and to provide the Ministry of the Environment with information concerning the validity of accreditation certificates.
