In accordance with the provisions of Government Emergency Order No 10/2018 amending and supplementing Government Emergency Order No 190/2000 on rules applicable to precious metals and precious stones in Romania, republished, as subsequently amended and supplemented, operations involving precious metals and precious stones may be performed by authorised economic operators solely on the basis of an authorisation issued by the National Consumer Protection Authority for an indefinite period, which is stamped annually by the latter.

Economic operators from Member States of the European Union, the European Economic Area and Turkey that are registered with the competent authority are not subject to authorisation by the National Authority for Consumer Protection with regard to operations involving precious metals and precious stones (in accordance with Article 8(7) of Government Emergency Order 10/2018).

Economic operators from Member States of the European Union, the European Economic Area and Turkey who are registered with the competent authority in their State of establishment are required to notify the National Authority for Consumer Protection before beginning operations involving precious metals and precious stones in Romania, including in the case of distance contracts and off-premises contracts, (in accordance with Article 8(8) of Government Emergency Order No 10/2018).

Order on the notification procedure, the notification form template and the template of the document issued by the National Authority for Consumer Protection (ANPC) following the notification, as well as aspects concerning the responsibility mark in the case of economic operators from Member States of the European Union, the European Economic Area and Turkey

The aim of the proposed legislation is to provide a high level of consumer protection and ensure discipline in the precious metals operations sector, given that this is a sensitive sector in which there are high levels of counterfeiting and tax evasion.

Economic operators from Member States of the European Union, the European Economic Area and Turkey who are registered with the competent authority in their State of establishment are required to notify the National Authority for Consumer Protection before beginning operations involving precious metals and precious stones in Romani, including in the case of distance contracts and off-premises contracts.

This notification should be submitted in writing, by post or in electronic format, and should include information making it possible to identify the trader and their registration with the competent authority and to verify that neither the economic operator nor any of the economic operator's employees has any definitive convictions for offences relating to precious metals and precious stones.

If there is no competent authority with which economic operators can register in a Member State of the European Union, the European Economic area and Turkey, operators shall request authorisation from the ANPC to perform operations involving precious metals and use the responsibility mark

The notification form template, the template of the document issued by the National Authority for Consumer Protection following the notification, the template for requesting the responsibility mark and the template of the responsibility mark are standard documents that may be found in the annexes to the draft order.

The National Authority for Consumer Protection will reply in writing to the trader within 30 days of the date on which the notification is registered.
