In an effort to reduce the concentration on the retail market and encourage the emergence of alternative drug marketing channels, the draft proposes that retailers (excluding pharmacies), that are included in the relevant list, be allowed to sell to the general public the non-prescription medicinal products included in the List approved by the Minister for Health (hereinafter referred to as ‘the List’).

Draft Law of the Republic of Lithuania amending Articles 2, 8, 19, 33, 35, 35(1), 59(1) and 68(1) of Law on Pharmacy No X-709 and adding Section 8(1) thereto

The draft Law on Pharmacy proposes the following substantive amendments:

1) to authorise the sale of the medicinal products included in the List to the general public in retail companies that are not pharmacies;

2) to determine the criteria on the basis of which the List shall be drawn up;

3) to license (include into the list) the legal entities wishing to sell the medicinal products included in the List under the licensing model ‘D’ (‘declaration’);

4) to allow public pharmacies to offer remotely the sale of prescription medicinal products, with the exception of medicinal products containing narcotic and/or psychotropic substances included in the List of controlled narcotic drugs and psychotropic substances approved by the Minister for Health, on the basis of electronic prescriptions; the entry into force of this provision shall be postponed until 1 May 2019;

5) to authorise the setting up of a hospital pharmacy in the personal health care institutions (PHCIs) that do not provide in-patient services;

6) to authorise the hospital pharmacy to sell (issue) to patients the reimbursed medicinal products prescribed for the purposes of treatment at the day care facility of this institution with the aim of providing healthcare services.
