Amendment of National Media and Infocommunications Authority Decree No 7/2015 of 13 November 2015 on national frequency allocation and the rules of use for frequency bands

This draft transposes the following two EU acts into national law:

a) Commission Implementing Decision (EU) 2017/1438 of 4 August 2017 amending Decision 2007/131/EC on allowing the use of the radio spectrum for equipment using ultra-wideband technology in a harmonised manner in the Community, and

b) Commission Implementing Decision (EU) 2017/1483 of 8 August 2017 amending Decision 2006/771/EC on harmonisation of the radio spectrum for use by short-range devices and repealing Decision 2006/804/EC.

By transposing the two aforementioned Commission Implementing Decisions and the latest version of CEPT ERC Recommendation 70–03 relating to the use of Short Range Devices (hereinafter referred to as ‘SRD’), following up the technological and market developments related to SRDs, while updating the relevant rules and regulations, opportunities arise for the use of new SRD applications, in accordance with EU and CEPT/ECC regulations.

This draft contains the results of the World Radiocommunication Conference 2015 (hereinafter referred to as ‘WRC-15’), in accordance with Annex 1 (International allocation) to National Media and Infocommunications Authority Decree No 7/2015 of 13 November 2015 on national frequency allocation and the rules of use for frequency bands (hereinafter referred to as the ‘Decree’).

On the basis of the 2014 NATO Joint Civil/Military Frequency Agreement (hereinafter referred to as ‘NJFA’), as well as its unclassified version published in 2017, the draft reflects changes in terminology and in the system of allocations related to harmonised NATO bands.

At the initiative of the Hungarian Radio Amateur Society, a review of frequency bands and performance restrictions applicable to the service of amateurs was launched. The results of this review to date are reflected in the draft.

In response to requests by users and taking into consideration the CEPT Recommendation, as well as the applicable ITU R Recommendation, the draft allows for the use of 80 MHz channel spacing in the 11 GHz frequency band.

Due to the amendment of the technical regulations applicable to the 12 GHz AM micro system in Budapest, the potential extension and development of the system will be possible, in support of a higher satisfaction of subscribers’ demands.

On the basis of requests by affected users in the 160 MHz band, the extension of operational deadlines will continue to ensure the possibility to use certain older types of non-civilian and civilian fixed and mobile systems (e.g. military and disaster management systems, certain PMR systems used by Hungarian State Railways).
