PRELIMINARY DRAFT LAW ON CERTAIN ASPECTS OF ELECTRONIC TRUST SERVICES

The Law on certain aspects of electronic trust services is being adopted to repeal Law 59/2003 of 19 December 2003 on electronic signatures and to supplement Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (OJ L 28.8.2014). It governs the aspects that the European Regulation leaves to the discretion of the Member States, such as penalties applicable at national level, the legal effects of certain qualified services, the liability and risk forecast system for service providers, verification of the identity and qualifications of applicants for qualified certificates, inclusion of additional requirements at national level for qualified certificates, such as national IDs or maximum periods of validity, and the system for suspending certificates.
