Draft Implementing Decree of the Ministry of the Environment of the Slovak Republic amending Implementing Decree of the Ministry of the Environment of the Slovak Republic No 410/2012 implementing certain provisions of the Clean Air Act, as amended.

The purpose of this draft amendment to the implementing decree is to transpose certain provisions of Directive (EU) 2015/2193 of the European Parliament and of the Council of 25 November 2015 on the limitation of emissions of certain pollutants into the air from medium combustion plants. This concerns, in particular, the establishment of emission limit values, the application of aggregation rules for new plants, and transitional measures relating to combustion plants with a total rated thermal input of 1 MW to 50 MW other than large combustion plants. These combustion plants are currently subject to national emission limit values. This amendment also addresses the shortcomings in the transposition of Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions identified under EU Pilot EUP (2019) 8980. The requirements for the development of reduction plans are being modified. Multiple options are provided for the calculation of target emissions. This is to ensure formal alignment with Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions. The changes do not affect the existing requirements, as the target emissions obtained using the calculation methods introduced will be the same as those obtained using the existing emission factors which follow from the Appendix to the Gothenburg Protocol. This amendment to the implementing decree also introduces new ClO2 emission limit values as the minimum air protection requirement for the bleaching process in cellulose production.
