Draft Implementing Decree of the Ministry of the Environment of the Slovak Republic amending Implementing Decree of the Ministry of the Environment of the Slovak Republic No 366/2015 on the record-keeping and reporting obligations.

Act No 90/2017 amending Act No 79/2015 on waste and on amendments to certain acts, as amended, introduced certain measures aimed at reducing the consumption of lightweight plastic carrier bags in accordance with Directive (EU) 2015/720 of the European Parliament and of the Council of 29 April 2015 amending Directive 94/62/EC as regards reducing the consumption of lightweight plastic carrier bags. It introduced an obligation for producers of packaging supplying lightweight plastic carrier bags to their customers to provide these bags in exchange for payment, together with the obligation to offer other types of bags. In order to assess the effectiveness of the measures aimed at reducing the consumption of lightweight plastic carrier bags implemented by the Slovak Republic, this draft requires persons fulfilling the definition of a producer of packaging by supplying plastic bags to their customers to keep record of and report the quantity of plastic bags supplied per calendar year. In Annex 16, the form ‘Report on the Packaging Placed on the Market within the Slovak Republic and Compliance with the Recovery and Recycling Rates for Packaging Waste’ is extended to include requirements for reporting on plastic bags in line with the scope of the records kept on them. Using the data obtained, the Slovak Republic will fulfil its reporting obligations vis-à-vis the European Union.

This draft implementing decree was drafted on the basis of a methodology being prepared by the European Commission, which will be adopted in an implementing act of the European Commission.
