Provisions on the technical conditions for transmitting electronic documents to courts and bailiffs and on the specific electronic official mailbox

e-Justice Regulation [ERVV]

The regulation lays down uniform provisions on e-justice with all federal and state courts insofar as § 130a of the Code of Civil Procedure, § 46c of the Labour Court Act, § 65a of the Social Courts Act, § 55a of the Code of Administrative Court Procedure and § 52a of the Code of Fiscal Court Procedure apply, particularly in the civil, labour, social, fiscal and administrative courts, and with bailiffs. Firstly, it regulates the technical conditions for submitting electronic documents to the courts and bailiffs. This includes in particular the formats of electronic documents, the requirements regarding structured data sets and the transmission of electronic documents with qualified electronic signature. Any further technical details on electronic communications, which require continual adaptation to technical developments, will in future be consistently communicated by the federal government. Secondly, it regulates the details of the specific electronic official mailbox which, once an identification procedure is implemented, will enable the transmission of electronic documents to the courts and to bailiffs via a secure transmission path.
