Single-use plastic bags

Ministerial Decree specifying the types of plastic bag not covered by the ban on using single-use plastic bags referred to in Article 4.6.2 of the Decree of the Government of the Brussels Capital Region of 1 December 2016 on waste management

Article 2, § 1 of the ministerial decree on which the notification is based states the following:

‘In accordance with Article 4.6.2, § 3 of the Decree of the Government of the Brussels Capital Region of 1 December 2016 on waste management:

- single-use plastic carrier bags paid for by the retailer before 1 September 2017 may be used until 30 November 2017;

- single-use plastic bags made of biosourced, home-compostable material and intended for the primary packaging of loose fruit and vegetables may be used until 29 February 2020. These bags must have a minimum biosourced material content of 40 % in 2018;

- single-use plastic bags intended solely for packaging foods sold at retail level that are wet or contain liquids liable to spill out may be used, provided the bag is sealed, biosourced and home-compostable. These bags must have a minimum biosourced material content of 40 % in 2018 and 60 % from 2025;

- very lightweight single-use plastic bags for the primary packaging of aquatic plants and animals may be used.

§ 2. Bags having a thickness exceeding 50 μm shall be deemed reusable within the meaning of Annex XII of the decree.’
