Decree setting out the specifications of electronic identification means presumed reliable, in accordance with Article 86(I) of Law No 2016-1321 of 7 October 2016 for a Digital Republic

The draft decree is issued in accordance with Article 86(I) of Law No 2016-1321 of 7 October 2016 for a Digital Republic, which supplements Heading I of Book III of the Postal and Electronic Communications Code with a new Article L136. The latter provides that proof of identity for the purposes of accessing an online communications service may be submitted by an electronic identification means and that the latter shall be presumed reliable until there is evidence to the contrary, when it meets the requirements of the specifications established by the National Cybersecurity Agency of France. This decree lays down the contents of the specifications and establishes the level of reliability required of the electronic identification means for the purposes of qualifying for the legal presumption of reliability as laid down in Article L136, second paragraph of the Postal and Electronic Communications Code.
