Act on the amendment of the Act on food safety and nutrition

The draft Act introduces an additional Chapter 6a on the labelling of products with ‘GMO-free’ labels to Section II of the Act of 25 August 2006 on food safety and nutrition. The basic premise of the Act is to regulate the normative requirements concerning the use of the term ‘GMO-free’ on the labelling of food products. The draft Act defines the subjective and objective scope and the conditions that must be met by the manufacturer or the entity placing the product on the market so as to allow the product to be labelled as ‘GMO-free’.

The basic objectives of the draft act are as follows:

- to define the following concepts: ‘GMO-free production’, ‘GMO-free’, ‘produced using GMOs’;

- to lay down the rules that the product must comply with in order to be labelled as ‘GMO-free’;

- to lay down the rules relating to the designation of GMO-free products in the production and labelling thereof;

- to determine of the number of entities able to apply for the ‘GMO-free’ product designation;

- to determine the requirements that must be met by the processing plant,

- to systematise the list of ingredients from which products of animal origin may be manufactured;

- to create a list of animal products of agricultural origin permitted for use in food production;

- to define the relevant (GMO-free) rules applicable to farming and animal husbandry;

- to create a list of substances authorised for the production of GMO-free food;

- to specify the entities responsible for monitoring the correct production of GMO-free food;

- to lay down the rules relating to the correct labelling and advertising of products;

- to define prohibited labelling, including terms and expressions used in trademarks;

- to specify the groups of experts responsible for supporting the Agricultural and Food Product Quality Inspectorate.

The basic premise is to define clear and transparent rules for the labelling of food according to the method of production and the ingredients used, thus allowing consumers to make an informed decision.

The aim of the proposed legislative changes is to implement detailed rules for the labelling of foods that were produced without using GMO ingredients or coming into contact with products not confirmed as ‘GMO-free’.
