Management of digital platforms for organising food and wine events.

Provision of restaurant services in private dwellings.

Draft parliamentary law concerning the rules for running a home restaurant business (Senate Act No 2647 - Text resulting from the consolidation of draft laws pursuant to Chamber of Deputies Act Nos 3258, 3337, 3725 and 3807)

The draft law is comprised of seven articles.

The first two articles state the purpose, aims and definitions used in the application of the law.

Article 3 specifies the obligations of digital platform operators and provides that, by decree of the Minister for Economic Development in agreement with the Minister for Economy and Finance, procedures shall be identified for guaranteeing control over activities carried out via digital platforms and for reporting any property units registered as venues for such events to municipalities.

Articles 4 and 5 specify activities to which the law does not apply; the terms and limits to be observed by cooking operators when running a restaurant in private dwellings; the requirements applicable to properties in which the activity is to be conducted; and the ban on running the business in residential dwellings used for non-business tourism/accommodation purposes or which are leased for periods of less than 30 days.

Article 6 establishes the applicable penalties where the business is run in violation of the legal requirements.

Article 7 provides that, as of the date of implementation of this law, no new or increased charges are to be incurred by the public treasury.
