Lightweight plastic carrier bags

Draft Legislative Decree implementing Directive (EU) 2015/720 of the European Parliament and of the Council of 29 April 2015 amending Directive 94/62/EC as regards reducing the consumption of lightweight plastic carrier bags

The notified draft Legislative Decree, drawn up in accordance with the technique for new legislation, modifies the packaging rules laid down in Heading II of Part IV of Legislative Decree No 152 of 3 April 2006 (the Environmental Code), with which European Parliament and Council Directive 94/62/EC was transposed into Italian law. The provision comprises 3 articles.

Article 1 modifies Articles 217 (scope of application), 218 (definitions), 219 (informing criteria for the management of packaging waste) and 224 (National Packaging Consortium) of the Environmental Code. New articles 220-bis (Reporting obligation on the use of plastic carrier bags), 226-bis (Prohibition of the marketing of plastic carrier bags), 226-ter (Reduction of the marketing of plastic carrier bags made from ultra-lightweight material) are inserted, along with three new paragraphs in Article 261 (packaging) on penalties.

Article 2 contains financial provisions, providing for the invariance of the burden on public finances.

Article 3 provides for the repeal of the provisions in force concerning the marketing of shopping bags, without prejudice to the penalty-related provisions adopted under previous legislation, before the entry into force of the provision in the notification.
