Substances covered by the draft law

1) U-47700; 3,4-dichloro-N-[2-(dimethylamino)cyclohexyl]-N-methylbenzamide

2) 5-MeO-DIBF; 2-(5-methoxy-1-benzofuran-3-yl)ethyl]bis(propan-2-yl)amine (included in the group of tryptamine and beta-(benzofuran-3-yl)ethanamines)

3) G-130; 2-Phenyl-5,5-dimethyltetrahydro-1,4-oxazine (included in the group of 2-fenilmorfolines)

4) methylmorphenate; methyl 2-(morpholin-3-yl)-2-phenylacetate

5) alprazolam triazole benzophenona derivative

6) deschloroetizolam

7) metizolam

8) nitrazolam

9) pyrazolam

10) ergometrine

11) ergotamine

Psychotropic substances fitting the description:

1) Tryptamine and beta-(benzofuran-3-yl)ethanamines

Any beta-(indol-3-yl)ethanamine or beta-(benzofuran-3-yl)ethanamine derivative (except serotonin, sumatriptan and zolmitriptan), which contains at least one substituent from rows a), b) and c):

a) where hydrogen atom(s) on the benzene ring is replaced with one or several identical or different substituents or substituents, which create a cyclic structure supplemental to the benzene ring;

b) where hydrogen atoms in an ethylene group are replaced with a non-substituted or substituted alkyl group;

c) where one or two hydrogen atoms in an amino group are replaced with a non-substituted or substituted alkyl group or a nitrogen atom included in the cycle

2) 2-fenilmorfolines

2-fenilmorfoline, its enantiomers and any compound derived therefrom:

a) by replacing the benzene ring with a thiophene or pyridine ring;

b) by replacing the morpholine cycle with a thiomorpholine cycle;

c) by replacing one or several hydrogen atoms in the benzene, thiophene or pyridine ring with a substituted or unsubstituted alkyl group, alkoxy group, amide group, amino group, sulfo group or substituents which create a supplemental benzene, thiophene or pyridine cycle;

d) by replacing one or several hydrogen atoms in the benzene, thiophene or pyridine ring with a hydroxyl group or halogen atom;

e) by replacing one or several hydrogen atoms in the morpholine or thiomorpholine cycle with a hydroxyl group, nitroso group, carbonyl group or substituted or unsubstituted alkyl group

3) Lysergamides (or amides of lysergic acid)

4,6,6a,7,8,9-hexahydroindol[4,3-fg]quinoline-9-carboxamides (except ergometrine, ergotamine, methylergometrine, methysergide), its enantiomers and any compound derived therefrom:

a) by replacing or not replacing one or several hydrogen atoms on the nitrogen atom in the amide group with unsubstituted or substituted alkyl group(s), or substituents which include the nitrogen atom in the cycle;

b) by replacing or not replacing a hydrogen atom on the nitrogen atom in the hydrogenated quinoline cycle with an unsubstituted or substituted alkyl group;

c) by replacing or not replacing a hydrogen atom on the nitrogen atom in the indoline cycle with an unsubstituted or substituted alkyl group or acyl group

Draft law on amendments to the Law on the procedure for the entry into force and enforcement of the criminal law

The draft law proposes to add to Annex 2 (Criteria for the quantity specifications of illicit narcotic drugs and psychotropic substances and medicines and substances which may be used to produce illicit narcotic drugs and psychotropic substances (precursors)) to the Law on the procedure for the entry into force and enforcement of the criminal law (hereinafter – Annex 2 of the Law) a number of psychoactive substances that present hazards to public health and safety, including four new psychoactive substances (1*) which currently are subject to a temporary 12-month ban imposed by the decisions of the Centre for Disease Prevention and Control (hereinafter – CDPC) regarding the production, purchase, storage, transportation, transfer or distribution of the relevant new psychoactive substances or products containing the substances (hereinafter – temporary ban decisions) (2*).

The draft law proposes to apply control measures also to known active metabolites of narcotic and psychotropic substances (including known active metabolite salts).

(1*) U-4770; 5-MeO-DIBF (included in the group of tryptamine and beta-(benzofuran-3-yl) ethanamines); G-130 (included in the group 2-phenylmorpholines), and methylmorphenate.

(2*) Pursuant to Article 4(2) of the Law on the procedure for the legal traffic in narcotic and psychotropic substances, which lays down that subject to the CPDC decision, the production, purchase, storage, transportation, transfer or distribution of the new psychoactive substances or products containing substances, which are not included in the schedule of controlled narcotic drugs and psychotropic substance and precursors and which have been notified through the EU Early Warning System or reported by a forensic body as a new psychoactive substance, may be banned or restricted for 12 months following the CPDC's decision.
