Proyecto de Orden por la que se establecen los requisitos sanitarios y de protección del medio natural para la importación de animales de especies para las que no exista normativa armonizada de la Unión Europea (Draft Order establishing health and natural environment protection requirements governing the importation of animal species not subject to harmonized European Union regulations)

The notified Order establishes requirements for the importation of live animals not subject to harmonized European Union regulations and having Spain as their final destination, including invasive species.

Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A (I) to Directive 90/425/EEC, establishes a series of health provisions applicable to imports of such products into the European Union.

Law No. 42/2007 of 13 December on Natural Heritage and Biodiversity, amended by Law No. 33/2015 of 21 September, stipulates under Article 54.2 that the general State administration shall prohibit the importation or introduction of allochthonous species or sub-species that could potentially compete with indigenous wild species, alter their genetic purity or affect ecological balances. In this context, it is necessary to adopt regulations governing the implementation of appropriate animal health and environmental protection requirements for the importation into Spain of live animal species not subject to harmonized European Union regulations.
