Draft Regulation of the Minister for Investment and Development amending the Regulation on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon

This draft regulation revises the Regulation of the Minister for Infrastructure and Construction of 17 November 2016 on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon (Journal of Laws [Dziennik Ustaw] 2016, item 1966).

This draft introduces amendments to Annex 1 to the Regulation laying down the groups of construction products subject to the requirement of drawing up a national declaration of performance and the systems of assessment and verification of constancy of performance required for such groups, and determines the period during which the manufacturer of a construction product listed in Annex 1 to the Regulation, which in accordance with the provisions applicable until 31 December 2016 was not subject to the requirement of applying a construction mark, is not required to draw up a national declaration when placing or making such a product available on the domestic market (in § 14 of the Regulation).

A transitional provision has been introduced (§ 2), in accordance with which the manufacturer of construction products listed in Annex 1 to this regulation in items 2, 10, 12, 23 and 33, which were not subject to the requirement of applying a construction mark before the date of entry into force of the regulation, is not required to draw up a national declaration when placing or making such a product available on the domestic market until 30 June 2019.
