Electronic cigarettes and refill containers

Regulations on electronic cigarettes and refill containers

§ 4 of the regulation imposes a language requirement on the information leaflet and the list of ingredients as per §§ 7 and 8 of the Act on electronic cigarettes. Current legislation does not have any language requirements regarding electronic cigarettes. As regards tobacco products, § 2 of the Tobacco Ordinance (2016:354) stipulates that the health warnings shall be in Swedish and Article 8(1) TPD states that Member States can require labelling in the official language or languages of the Member State. Article 8(1)(b) of Directive 2001/95/EC of the European Parliament and of the Council on general product safety also contains a requirement stipulating that any product that could pose risks in certain conditions shall be marked with suitable warnings in the official languages of the Member State in which the product is marketed. Given that the information leaflet and the list of ingredients shall serve a purpose for the consumer, it has been concluded that they shall be in Swedish in cases where the product is placed on the Swedish market.

In order for manufacturers and importers to be able to adapt their products to the language requirement, a transitional provision is introduced, under which electronic cigarettes and refill containers that have been put into free circulation before the regulations enter into force and which do not meet the language requirement may be on the Swedish market during a transitional period. The transitional period has been set at 6 months.
