This law applies to all foods intended for the final consumer, including foods delivered by mass caterers and foods intended to be supplied to the latter. Foods that naturally contain trans fats in animal fats are excluded from the scope of this law.

Law on the trans-fat content of foods intended for human consumption

Food business operators shall be obliged to place on the market only foods with a maximum trans-fat content of 2 g/100 g of the total oil or fat content. The same provisions also apply to foods from third countries and other Member States. Failure to comply with the provisions shall constitute a contravention and be sanctioned with a fine of between RON 10 000 and RON 30 000. Accordingly, foods that do not comply with the legal provisions shall be withdrawn from circulation for human consumption.

In the case of products that do not comply with the legal provisions, food business operators shall initiate recall/withdrawal procedures to remove the food from the market and inform the competent authorities thereof.
