Decree concerning the electronic registered delivery service, issued pursuant to Article 93 of Law No 2016-1321 of 7 October 2016 for a Digital Republic

This draft decree is issued in accordance with Article 93 of Law No 2016-1321 of 7 October 2016 for a Digital Republic, which will shortly supplement Heading I, Book III of the Postal and Electronic Communications Code with a new Article L100. Said article introduces an equivalence between ‘electronic registered delivery’ and ‘delivery by registered post’, provided that it meets the requirements of Article 44 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC. This decree lays down the conditions of application in order to ensure that sending an electronic registered letter and an electronic registered letter printed on paper is equivalent to sending a letter by registered post.
