National Media and Infocommunications Authority Decree amending certain National Media and Infocommunications Authority decrees on frequency management

Based on the draft, the following decrees are amended:

• National Media and Infocommunications Authority Decree No 7/2015 of 13 November 2015 on national frequency allocation and the rules of use for frequency bands (hereinafter: ‘Decree No 7/2015’),

• National Media and Infocommunications Authority Decree No 1/2011 of 31 March 2011 on the fee for frequency allotment and frequency use (hereinafter: ‘Decree No 1/2011’),

• National Media and Infocommunications Authority Decree No 7/2012 of 26 January 2012 on certain official civil frequency management procedures, and

• National Media and Infocommunications Authority Decree No 11/2011 of 16 December 2011 on certain official non-civil frequency management procedures (hereinafter: ‘Decree No 11/2011’).

In the mobile-satellite service (MSS) band 2 GHz (1980–2010 MHz for Earth-to-space communications (uplink) and 2170–2200 MHz for space-to-Earth communications (downlink)), the amendment includes the introduction of the Aero-CGC concept and the requirements that ensure smooth operation. The deployment of Aero-CGC also means that slight amendments need to be made to Decree No 1/2011.

Currently, only the Frequency Division Duplex (FDD) access mode is possible in the frequency band 3400-3600 MHz based on Decree No 7/2015. Under the amendment, the Time Division Duplex access mode will be available in this band instead of FDD.

Determining the status of the band 5030–5091 MHz planned for unmanned aircraft informs the market as to how this band can be used in the future. The band can be designated on the basis of actual technical conditions laid down by international regulatory and standardisation bodies.

In the bands 18 GHz, 26 GHz and 38 GHz, new high capacity systems can be introduced, which may serve networks that generate increased data traffic (including, inter alia, mobile network stations with a transmission demand as low as a few hundred Mbit/s).

In the field of non-civil frequency management, changing demands and terminology mean that legal requirements need to be clarified. This does not result in changes in the concept. The changes affect the regulation of the multifunctional military information distribution system MIDS/LINK16 using the band 960–1215 MHz and the military use of the band 4.4–5 GHz.

The official non-civil frequency management procedures will now include the simplified radio permit tried and tested in civil frequency management to replace the hitherto facilitated permission procedure. The amendment affects both Decree No 11/2011 and Decree No 7/2015. In addition to the explanatory provisions, the changes in Decree No 7/2015 also affect the regulation of the bands 59–64 GHz, 71–76 GHz and 81–86 GHz.
