Act amending the Chemicals Act and amending other legal provisions governing chemicals

The Act contains amendments to the Chemicals Act [Chemikaliengesetz, ChemG] and to other legal provisions governing chemicals, substantially containing the following:

1. Final alignment of the concept of ‘hazardous’ in § 3a ChemG, of the labelling regulations in § 13 ChemG and of various related detailed regulations with Regulation (EC) No 1272/2008 (CLP Regulation) for when the transitional provisions set out therein come to an end;

2. Amendments to the national transitional provisions regarding biocidal products in § 28 ChemG in view of amendments made to relevant EU law in the interim;

3. Amendments to the current national provisions concerning the duty to register the formulations of chemicals for the purpose of emergency health care in §§ 16e and 28 ChemG, § 10 of the Detergents and Cleaning Products Act [Wasch- und Reinigungsmittelgesetz] and in the Ordinance on Information on Poisons [Giftinformationsverordnung] in view of the new Annex VIII to the CLP Regulation, which enters into force at the start of 2020. The amendments will be staggered up to and after the entry into force of the new EU provisions, and will thus start entering into force from 1 January 2020 onwards;

4. Supplementing the provision on mail-order trade in § 10 of the Prohibition of Chemicals Ordinance [Chemikalien-Verbotsverordnung] and extending the power to issue statutory instruments in § 17 ChemG on which said ordinance is based, with a view to facilitating enforcement in the e-commerce field.
