‘Particularly hazardous chemical products’ under § 2 of the Ordinance (2008:245) on chemical products and biotechnological organisms and Chapter 4, § 1 of the Swedish Chemical Agency's regulations (KIFS 2008 2) on chemical products and biotechnological organisms, i.e. products which when classified in accordance with Regulation (EC) No 1272/2008 (the ‘CLP Regulation’) belong to

– the hazard class ‘Acute toxicity’ in hazard categories 1, 2 and 3 and which are to be labelled with the hazard pictogram ‘Skull and crossbones’ (GHS06) and the signal word ‘Danger’

– any of the hazard classes ‘Carcinogenicity’, ‘Germ cell mutagenicity’ or ‘Reproductive toxicity’ in hazard categories 1A or 1B and which are to be labelled with the hazard pictogram ‘Health hazard’ (GHS08) and the signal word ‘Danger’, or

– the hazard class ‘Skin corrosion’ in hazard category 1A and which are to be labelled with the hazard pictogram ‘Corrosion’ (GHS05) and the signal word ‘Danger’

– any of the hazard classes ‘Specific target organ toxicity — Single exposure’ or ‘Specific target organ toxicity — Repeated exposure’ in hazard category 1 and which are to be labelled with the hazard pictogram ‘Health Hazard’ (GHS08) and the signal word ‘Danger’.

Regulations amending the Swedish Chemicals Agency’s regulations (KIFS 2008:2) on chemical products and biotechnological organisms

The statutory proposal contains an updated list in Chapter 4, § 1 KIFS 2008:2 of the hazard classes which define the concept ‘particularly hazardous chemical products’ and which trigger application of the national permit rules in the Ordinance (2008:245) on chemical products and biotechnological organisms. The draft also includes an updated enumeration in Chapter 4, § 2 KIFS 2008:2 of which substances and product groups are to be exempt from the permit requirement in the ordinance.
