Food supplements

Regulation of the Minister for Health amending the Regulation on the composition and labelling of food supplements

The amendment to the regulation:

- adds (6S)-5-methyltetrahydrofolic acid (glucosamine salt) to the list of chemical forms of vitamins that can be used to manufacture food supplements;

- lays down the minimum quantities of vitamins and minerals in food supplements in the recommended daily intake at 15 % of reference intake values specified in point 1 of Part A of Annex XIII to Regulation (EU) No 1169/2011;

- harmonises the nomenclature and the manner of describing vitamins and minerals referred to in Annexes to the Regulation of the Minister for Health (Annex 1, and paragraph 5 and point 1 of paragraph 6 of Annex 2);

- repeals Annex 3 to the Regulation of the Minister of Health, as the content of the provision refers to Regulation (EU) No 1169/2011 which contains reference intake values in point 1 of Part A of Annex XIII, meaning it is unnecessary to repeat the wording of this provision;

- proposes a new wording for § 3. The regulation currently in force refers to provisions issued pursuant to Article 10(5) of the Act on food safety and nutrition of 25 August 2006. At present, the additional substance specifications are governed by EU legislation;

- proposes a new wording for § 5(1). The regulation currently in force refers to provisions issued pursuant to Article 50(1) of the Act on food safety and nutrition of 25 August 2006, which was repealed. For this reason, § 5(1) was amended accordingly and now has the following wording: ‘The labelling of food supplements is regulated by the provisions of Regulation (EU) No 1169/2011, taking into account paragraphs 2-7.’
