Proposed amendments to the 'Enforcement ordinance of Framework Act on Product Safety' (8 page(s), in Korean)

Under Article 13-2 (1) of the Framework Act on Product Safety, when accidents involving products are reported, the head of a central administrative agency may order business owners to investigate the details and cause of the accidents, taking into consideration the frequency of accidents, risks and their own personal capabilities.

*        The term "business owner" in this document refers to any person who manufactures, assembles, processes or imports products according to subparagraph 1 of Article 3 of the Framework Act on Product Safety.

The methods, procedures and reports for an accident investigation

-        With respect to the methods, Article 16 (1) of the Enforcement ordinance of Framework Act on Product Safety shall apply mutatis mutandis.

-        Under Article 13-3 (1) of the Framework Act on Product Safety, a business owner who receives an order to carry out an accident investigation shall organize an accident investigation team. They shall report to the head of a central administrative agency their plans for a product accident investigation within 7 days, and the results of the investigation within 3 months from the date they received the order. *          A business owner who receives an order for supplementation regarding their reports from the head of a central administrative agency shall supplement and resubmit their plans for a product accident investigation within 3 days, and the results of the investigation within a month from the date they received the order.
