Commercial vessels, recreational craft and floating equipment

Order on the classification of waterway zones for commercial vessels, recreational craft and floating equipment and supplementing or reducing the applicable technical requirements in certain waterway zones

A draft ministerial order is hereby notified to the European Commission pursuant to Directive (EU) 2015/1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services.

Pursuant to Article L5241-1 of the French Transport Code, vessels are authorised to navigate downstream of the transverse sea limit, subject to specific technical requirements laid down by ministerial order.

Pursuant to Directive (EU) 2016/1629 (which is currently being transposed and will enter into force on 7 October 2018), this draft order aims to create Zone 1 waterways for vessels and floating equipment and introduce related technical requirements adapted to the different estuaries and vessel types. It incorporates the provisions of the following orders:

o Order of 15 December 2014 on the navigation at sea of river container ships serving Port 2000 and the Seine quays in Honfleur

o Order of 30 March 2015 on the navigation at sea of river passenger vessels serving the Saint-Nazaire basins in the Grand Port Maritime de Nantes - Saint-Nazaire

Order of 28 July 2016 on the navigation at sea of river tanker vessels serving Port 2000 for the purposes of provisioning and servicing ships

In addition, the draft includes the content of the Order of 16 December 2010, which defined the waterway zones linked to the supplemented or reduced technical requirements, i.e. Zones 2, 3 and R.

This order will repeal the four orders mentioned above.
