Draft implementing decree amending Implementing Decree No 429/2009 laying down the particulars of the extractive waste management plan, including assessment of the properties of waste and certain other details, to implement the Extractive Waste Management Act

The purpose of the proposed legislation is to refine the requirements for the content and particulars of extractive waste management plans, taking into account the type of activity undertaken, and for keeping design and operating documentation in accordance with the requirements for work and operational safety so that the plans reflect not only the possibility of disposing of extractive waste at a disposal site, but also the possibility of reusing it, i.e. provisions on the management of extractive waste outside disposal sites. The assessment of the properties of extractive waste is extended to include the assessment of its oxidation properties and assessment of potential geochemical alterations in the body of the heap. The assessment for the purposes of categorising disposal sites is extended to include the factor of possible disruption of the structure of the heap due to the formation of a cavern in the body of the heap.
