Commodities Act Order on food supplement exemptions

This notification replaces notification 2017/546/NL. In light of the Commission's comments, this order is also being notified under Regulation (EU) No 1169/2011. In addition, some amendments have been made to Article 5 of the order since the previous notification. The date of entry into force has also been amended.

Article 10(1) of the Commodities Act Decree on foodstuff preparation and treatment (hereinafter: the ‘Decree’) stipulates, inter alia, that beverages and foodstuffs shall not contain vitamins unless those vitamins are naturally present in the beverages and foodstuffs in the same composition and quantity.

The Commodities Act Order on vitamin preparation exemptions grants an exemption from Article 10(1) of the Decree for vitamins A and D, under certain conditions. What is new is that an exemption is also granted for vitamin B6 under certain conditions. The decision was made to adopt a new exemption order.
