Biocidal products are:

— any substance or mixture, in the form in which it is supplied to the user, consisting of, containing or generating one or more active substances, with the intention of destroying, deterring, rendering harmless, preventing the action of, or otherwise exerting a controlling effect on, any harmful organism by any means other than mere physical or mechanical action;

— any substance or mixture, generated from substances or mixtures which do not themselves fall under the first indent, to be used with the intention of destroying, deterring, rendering harmless, preventing the action of, or otherwise exerting a controlling effect on, any harmful organism by any means other than mere physical or mechanical action.

A treated article that has a primary biocidal function shall be considered a biocidal product.

Royal Decree on the making available on the market and use of biocidal products

The proposed amendment to the Royal Decree of 8 May 2014 on the making available on the market and use of biocidal products is intended to simplify the procedure for making biocidal products available on the market in Belgium during the transition to the European procedure.

What does the simplification consist of?

The current criteria for placing a product on the market shall be retained: a product must be effective and safe for people and the environment (Article 5). However, the responsibility for this shall fall to the applicant, and the evaluation shall be limited to determining the classification and labelling and to evaluating their efficacy in limited cases (= ‘registration’). In cases of indications that the product does not meet the necessary criteria, the product shall undergo a full evaluation. The applicant shall be entitled to raise an objection to this decision as well as to the outcome of the evaluation at any time.
