Draft Implementing Decree of the Ministry of the Environment of the Slovak Republic amending Implementing Decree of the Ministry of the Environment of the Slovak Republic No 411/2012 on the monitoring of emissions from stationary air pollution sources and of air quality close to said sources

The purpose of this draft implementing decree is to transpose selected provisions of Directive (EU) 2015/2193 of the European Parliament and of the Council of 25 November 2015 on the limitation of emissions of certain pollutants into the air from medium combustion plants (hereinafter the ‘MCP Directive’) in relation to monitoring emissions of pollutants into the air. The MCP Directive applies to medium combustion plants with a rated thermal input (hereinafter ‘RTI’) of 1 MW to 50 MW. With regard to the monitoring of emissions, it lays down, among other things, the intervals between regular (periodic) emission measurements: every three years for plants with an RTI of 1 MW to 20 MW and every year for plants with an RTI of 20 MW to 50 MW.

Under the existing implementing decree, combustion plants with an RTI of 0.3 MW to 50 MW are organised differently for monitoring purposes. The periodic measurement intervals are every six years and every three years, depending on the RTI and the type of fuel used. The requirements for plants with an RTI of 0.3 MW to 1 MW remain unchanged (the interval of once every six years is retained). In this context, § 9 of the implementing decree (‘Combustion plants’) is amended so that it conforms to the emission monitoring requirements of the MCP Directive.

The draft implementing decree also addresses a shortcoming in the transposition of Directive 2010/75/EU of the European Parliament and of the Council in relation to the monitoring of emissions from large combustion plants identified under EU Pilot EUP(2016)8980 of 3 November 2016. This draft implementing decree clarifies and amends certain provisions based on experience in practice, in particular with regard to checks of automated emission measuring systems and calibration of their measuring instruments (analysers) in connection with new point (d) in § 9(8) of Act No 142/2000 on metrology and on amendments to certain acts, as amended.
