Key points: notification obligation, potatoes originating in Spain

Those bringing potatoes originating in Spain into Germany for professional or commercial purposes shall notify the competent authorities of the arrival of the potatoes at the latest one working day prior to their expected arrival, stating the date, the storage location or processing location in Germany, and the region of Spain where the potatoes were cultivated. They shall allow the competent authorities to inspect said potatoes. The competent authorities may inspect the potatoes.

In this respect, the notification obligation only affects commercial recipients of Spanish potatoes in Germany. The placement on the market of potatoes originating in Spain shall remain unaffected and can continue in accordance with the applicable EU law, including Commission Implementing Decision 2012/270/EU, last amended by Decision 2016/1359/EU.

No intra-Community trade barriers are created as a result.
