By way of this agreement, the state-owned limited liability company Digitális Jólét Nonprofit Korlátolt Felelősségű Társaság (Trademark Proprietor’ creates the opportunity for electronic communications providers, as referred to in § 188, point 14 of Act C of 2003 on electronic communications (hereinafter: the ‘Act’), which have successfully applied for use of the ‘Digital Prosperity Basic Package’ trademark, to use the said trademark.

By entering into the Trademark Agreement, the Trademark User acquires a non-exclusive right, free of charge from the Trademark Proprietor, to use the trademark for trademarks related to Internet access services, as referred to in § 188, point 58 of the Act, that it distributes and provides independently.

Draft trademark agreement for the ‘Digital Prosperity Basic Package’ trademark

The objective of the agreement is to implement the Internet basic package, pursuant to point 2(g) of Government Resolution No 2012/2015 of 29 December 2015 on the Digital Prosperity Programme, and to develop the ‘Digital Prosperity Basic Package’, thus allowing for lower than ever retail prices for Internet access subscription to all those who have so far been unable to subscribe for service provision due to the excessive cost of using the Internet.

In order to avoid prohibited market manipulation, the Basic Package is implemented on behalf of communications providers in the form of a trademark that creates the opportunity for voluntary connection, which in its terms and conditions ensures that users of the Basic Package are fully able to exploit the opportunities of the Internet for a monthly fee that is at least 15 % more favourable than discounted market tariffs.

The Basic Package is introduced in the form of a trademark, and is therefore voluntarily included in the supply of electronic communications providers. By using a trademark that is guaranteed to have an appropriate legal environment, service providers can ensure provision of the Basic Package is advantageous to them, thus guaranteeing appropriate services and affordable prices to future subscribers.

The intention is to launch the Basic Package in such a way that as many potential subscribers as possible look for services provided with the ‘Digital Prosperity Basic Package‘ trademark, and that services provided with said trademark are important players on the Internet subscription market in the medium term.

Another objective of creating and operating the Basic Package is to help develop a conscious consumer culture.

In order to fulfil these objectives, the Prime-ministerial Commissioner for establishing trademarks, coordination and implementation of the Digital Prosperity Program initiated a trademark notification procedure pursuant to Act XI of 1997 on the protection of trademarks and geographical indications.

The ‘Digital Prosperity Basic Package’ coloured figurative mark was registered by the Hungarian Intellectual Property Office on 14 December 2016, as published in issue 23, year 121 of the Gazette for Patents and Trade Marks (Registration No 220.156).

The state-owned limited liability company Digitális Jólét Nonprofit Korlátolt Felelősségű Társaság, which operates through the asset management of Magyar Nemzeti Vagyonkezelő Zrt. and under the professional supervision of the Prime-ministerial Commissioner, shall perform trademark proprietor tasks.

Regulation of the Basic Package has been prepared with the involvement of relevant social, civic, professional and market players.
