The proposed Regulations address the installation, operation, maintenance and frequency of periodic checks of LPG facilities and storage sites, as well as the frequency of periodic checks of LPG tanks. The Regulations also lay down the authorisation criteria for persons pursuing the profession of LPG Facility Fitter, LPG Facility Inspector and Inspection Body and their obligations, as well as the obligations for owners of such LPG storage sites/facilities.

The Regulations lay down the technical safety requirements and set out the procedures to be followed to install, operate and maintain LPG storage sites and facilities. They also set out the obligations of the professionals involved (i.e. the LPG Facility Fitter, the LPG Facility Inspector, the LPG Supplier and the Inspection Body) as well as of the LPG Owners. Periodic checks of LPG storage sites and facilities are to be carried out by Authorised LPG Inspectors.

LPG Facility Fitters and Authorised LPG Inspectors are to be approved by the Department of Labour Inspection on the basis of statutorily-enacted criteria and will assume specific obligations. Moreover, the criteria for the Department of Labour Inspection authorising the Inspection Bodies (bodies which already periodically inspect LPG tanks based on the existing national legislation) have been improved.

There is a new improved, modernised Inspection System used to confirm the suitable and safe operation of LPG storage sites and facilities throughout their entire useful life.

The existing permitting process for LPG storage sites and facilities in force today under the Petroleum Products legislation will be abolished. A new control procedure will be introduced in its place, which will require a Compliance Folder to be submitted to the competent authority for large LPG storage sites and facilities only (for tanks with over 2 500 l capacity or containers over 1 500 kg capacity) which will also include inspection by the Department of Labour Inspection. The Compliance Folder will include all documents, technical information and so on needed to document the legality and safety of the LPG storage sites and facilities.
