On the proposal of the National Addictology Centre [Országos Addiktológiai Centrum — OAC] of the National Institute for Health Development, 18 new unique psychoactive substances susceptible to abuse will be listed in the schedule of Annex 1 to the Decree. Moreover, 13 new unique psychoactive substances will be removed therefrom, given that as a result of risk assessments, they will be moved to the law and government decree schedule that provides for more stringent control. In addition, the new psychoactive substance MT-45 will be removed from the schedule of the Decree because, based on the Council Implementing Decision (EU) 2015/1873, said substance has been moved to the law and government decree schedule that provides for more stringent control.

Amendment of Minister for Human Capacities Decree No 55/2014 of 30 December 2014 on substances or groups of compounds classified as new psychoactive substances (the ‘Decree’)

Based on the professional opinion of the OAC, the 18 new unique psychoactive substances to be included in the Schedule to the Decree will not be permitted to be freely marketed in Hungary; any activity related to their use will only be permitted following registration with the authorities.

The removal of the 14 new unique psychoactive substances from the Schedule to the Decree and their inclusion in law and government decree schedules containing hazardous psychotropic substances shall form the basis of the fact of drug abuse; said removal and inclusion provide for more stringent control.

In view of this, health risks will be reduced, as it will be made more difficult for substance abusers to gain access to these substances.

Furthermore, making a technical amendment to the structural descriptions in the Schedule to the Decree is justified in order to clarify a previous amendment that can be interpreted ambiguously.
